Back Payment of Wages/Salary Claims

Many employers unintentionally underpay their employees the correct remuneration that the employees are entitled to. The incorrect payment is usually brought about through the employer not having access to information that will allow them to correctly interpret pay obligations relating to correct classification and penalty payments. The Fair Work Ombudsman and its Inspectors are able to launch actions in the Federal Magistrates Court, which have resulted in the employer having to make up the back pay. Employers are also subject to large fines for each breach of the law. Prudent employers take advice to ensure that any decision they make in relation to an employee’s remuneration is an informed decision.
